Humanitarian & Compassionate (H&C) Applications

Some foreign nationals currently living in Canada, who found that they need an exemption from one or more requirements of the Immigration and Refugee Protection Act (IRPA) or Regulations, may use the H & C application category to apply for permanent residence in Canada. Usually these individuals are not eligible to apply under common immigration programs or they have already exhausted their options.

IRCC assesses H&C applications on a case-by-case basis. Usually before the decision, the following factors are considered:

• The level of settlement of the applicant in Canada
• Family ties to Canada
• The best interests of any children involved, and
• What could happen to the applicant and dependents if application is refused
